Terms of Service

These Terms of Service (“Agreement”) constitute a binding legal agreement between you (“Customer,” “you,” or “your”) and Industry Careers, Inc. (“Industry Careers,” “we,” “our,” or “us”) and govern your use of our recruiting automation services (the “Service”). By accessing or using the Service, you agree to be bound by this Agreement. If you do not agree, do not access or use the Service.

1. Service Overview

Industry Careers provides a proprietary AI-driven recruiting automation platform ("Service") designed to streamline the hiring process by eliminating manual recruiting tasks. The platform includes but is not limited to:

  • Job description generation

  • Job distribution to job boards

  • Resume screening and outreach

  • AI-led interviews

  • Interview scheduling

  • Offer letter drafting

  • Hiring strategy consultation

  • Branded AI interviewer creation

  • Candidate engagement and delivery

All services are delivered via our web platform, automated systems, and human quality assurance team.

2. Subscription Plans & Billing

2.1 Month-to-Month Subscription

Monthly plans are billed in advance on a recurring monthly basis. You may cancel anytime via our support portal. Canceling mid-month does not entitle you to a refund, credit, or rollover. Access continues until the end of the billing cycle.

2.2 Annual Subscription

Annual plans are billed in full at the start of the subscription term. All annual fees are non-refundable. Cancellation prior to the end of the term does not result in a pro-rated refund or credit.

2.3 Cancellation & Pause Policy

  • All cancellations or pause requests must be submitted through our 24/7 Customer Support Portal accessible through your client dashboard. Requests via email, phone, or text must be confirmed through the portal to be valid.

  • If you request to cancel your account but submit a new recruiting request or activate a new search during your remaining billing cycle, your cancellation will be considered void. Submitting a new request constitutes reactivation of your account and agreement to resume services under the current billing terms. No refunds or credits will be issued for time remaining in the original billing cycle once reactivation occurs. Billing will continue until a cancel or pause request is submitted through the customer portal.

3. Definition of "In Production"

The Service is considered "in production" upon the initiation of any of the following actions:

  • Job posting to boards

  • Candidate outreach

  • Candidate interviews

  • Scheduling activities

  • Offer letter preparation

  • Building of AI Interviewer demo

  • Hiring consultation or support

Once the Service enters production, the billing for that cycle is considered earned and non-refundable.

4. Eligibility

You must be at least 18 years of age and have the authority to bind the entity you represent. You represent that all information provided to Industry Careers is accurate and complete.

5. Intellectual Property

All content, software, algorithms, and intellectual property provided as part of the Service are the exclusive property of Industry Careers, Inc. or its licensors. You may not reproduce, modify, distribute, or reverse-engineer any portion of the Service without express written consent.

Your branded AI Interviewers and career pages are powered by Industry Careers’ underlying system and do not confer intellectual property ownership or source code access.

6. Data & Privacy

We collect, use, and store data in accordance with our Privacy Policy. You agree to allow us to use anonymized and aggregated data for performance improvement, analytics, and benchmarking purposes.

You retain ownership of your candidate data. Industry Careers does not contact your candidates outside the scope of services provided.

7. Acceptable Use

You agree not to:

  • Use the Service for illegal or unauthorized purposes

  • Interfere with the operation of the platform

  • Upload or transmit viruses or harmful code

  • Attempt to gain unauthorized access to our systems

  • Misrepresent job roles or hiring intent

Violation of this policy may result in immediate suspension or termination of access.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE HIRING OUTCOMES OR SPECIFIC CANDIDATE RESULTS. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INDUSTRY CAREERS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO INDUSTRY CAREERS IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Industry Careers, Inc. and its officers, employees, and affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service, violation of this Agreement, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your access at any time for violation of these terms, without liability. Upon termination, all rights granted to you will cease immediately.

12. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute shall be resolved through binding arbitration in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association. Each party waives the right to participate in a class action.

13. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between the parties.

  • Amendments: We may amend these Terms at any time. Updates will be posted on our website.

  • Severability: If any part of this Agreement is found to be unenforceable, the remaining provisions will remain in full force.

  • Force Majeure: We are not liable for delays or failure to perform due to causes beyond our reasonable control.
